El Paso lawmaker introduces bills to shield minors from AI-generated explicit content


An El Paso lawmaker proposed a bill to protect children from AI-generated pornography.

State Representative for District 75 Mary Gonzalez announced on Wednesday that she proposed two bills to keep Artificial Intelligence software that create porn away from children.

The first one, House Bill 581, is meant to keep underage users from creating AI porn by ensuring that AI software verifies the age of its users, and also require that– in the case of deepfake (when someone’s face is imposed onto sexually explicit images)– the AI tool makes sure the person depicted is 18 years or older and is consenting to the use.

The second one, House Bill 421, would also require AI deepfake generators to get consent from the people in the images, and will also allow people to sue AI tools if no consent was given.

“The humiliation, degradation, and dehumanization inflicted on the victims can be crippling. The injury can be so profound that students and teachers can’t return to the classroom,” said Gonzalez. “We have to keep harmful AI tools out of the hands of young people who do not comprehend the damage done by deep fake videos. The companies that have built these websites, apps and programs do almost nothing to keep children from making and spreading these videos.”

Gonzalez said she is offering a package of four bills to curb abuses and the other bills are in different committees.

“We must protect everyone, but especially children, from being victimized by sexually explicit deep fake videos. The companies that have created these image generators haven’t prevented children and nonconsenting adults from appearing in these deep fake videos,” said Gonzalez. “The point of my bills is to keep children from creating and appearing in these videos. No person using an image generator should be able to turn anyone else into a pornographic actor at the push of a button.”
